Community Investments Office

unprecedented penalties against refineries

WeestablishedanewCommunityInvestmentsOfficetodevelopandmanagetailoredprogramsforfundingstreamsgeneratedbypenaltiesandrelatedfunds.

TheCommunityInvestmentsOfficewilloverseethereinvestmentofpenaltiespaidbyviolatorsbackintothelocalcommunitieswheretheviolationsoccurredtofinanceprojectsaimedatreducingairpollutionexposure,mitigatingairpollutionimpacts,andimprovingpublichealth.ThisdirectionofpenaltyfundsbackintothecommunitiesimpactedbytheviolationsistheresultofagroundbreakingpolicythatourBoardofDirectorsadoptedinMay.Underthispolicy,allpenaltieswecollectaboveaspecifiedamountthatisretainedtooffsetthecostsofinvestigatingandprosecutingtheviolationswillbeallocatedtolocalprojectsspecificallydesignedtoreducepollutionandenhancepublichealth.

Thenewofficewillhavesubstantialfundstouseforthesepurposesthankstorecord-breakingpenaltieswecollectedin2024,includingthreemajorpenaltiesagainstBayArearefineries.InFebruary,wefinedChevronUSAInc.$20millionforviolationsatitsrefineryinRichmond;inOctober,wefinedMarathonMartinezRefinery$5millionforviolationsatitsrefineryinMartinez;andinNovember,incollaborationwiththeCaliforniaAirResourcesBoard,wesecuredanearly$82millionpenaltyagainstValeroRefiningCo.forviolationsatitsrefineryinBenicia.Thesearethelargestpenaltieseverassessedinouragencyshistoryandareapowerfuldemonstrationofourcommitmenttoholdingpollutersaccountable.

TheCommunityInvestmentsOfficewillalsooverseethedisbursementofcommunityfundsChevronhasagreedtopayinresolutionofitslawsuitoverRegulation6,Rule5,arulethatourBoardofDirectorsadoptedin2021toreduceparticulateemissionsfromrefineriesandachievemajorhealthbenefits.ChevrondroppeditslawsuitinFebruaryandagreedtopay$20milliontocreateacommunityairqualityfundtoprovidefundingforprojectsandprogramstoreduceparticulatematteremissionsandexposuresinthevicinityofChevron'sRichmondrefinery.

Environmental justice impact

InSeptember,AB1465Wickswassignedintolaw,markingamajorvictoryforpublichealthandenvironmentaljusticeinCalifornia.Westronglysupportedthisbill,whichtriplesthepenaltyceilingsforairqualityviolationsatTitleVsources,includingrefineries,significantlyincreasingthepotentialconsequencesforfacilitiesthatviolateairqualityregulations.

Implementation Working Group on Building Appliance Rules

Air quality and public health

Adoptedin2023,Rules9-4and9-6establishzero-nitrogenoxideemissionsstandardsthatwillapplytonaturalgaswaterheatersandhomefurnaceswithaphasedimplementationthrough2031.Aspartofruleadoption,weformedtheImplementationWorkingGroupIWGwithafirstfocusonRule9-6homewaterheaterstandardsthattakeeffectJanuary1,2027.TheIWGheldextensivestakeholderdiscussionsandguidedfocusedtechnicalresearchonissuesofpublicconcern.Thisprocessgeneratedsignificantnewinformation,data,andfindingstoinformruleimplementation.

WeestablishedanewairmonitoringstationinBeniciaaspartofourMajorStationarySourceCommunityAirMonitoringProgram.Launchedin2016,theprogramfocusesonestablishingorexpandingairmonitoringstationsinareaswherelargestationarysourcesofpollutionmaycontributetonear-sourceimpactsthatarenotcapturedbytheAirDistrict'sexistingnetwork.Weareinitiallyprioritizingcommunitieswithpetroleumrefineriesandlargerenewablefuelsmanufacturingfacilities,suchasBenicia.
